PRODUCT WARRANTY

This warranty covers all commercial products, all engineered systems, and software of 

Sunbelt Mechatronics LLC.

Warranty Period:

The warranty period is twelve (12) months from the installation date.

Scope of Warranty:

This warranty covers defects in materials and workmanship under normal use and service.

Exclusions:

This warranty does not cover the following:

  • Wearing Parts: Parts subject to normal wear and tear are excluded from this warranty. These may include, but are not limited to:

  • Parts in mechanical contact

  • Moving parts

  • Parts under pressure

  • Parts that may come into contact with corrosive or abrasive substances (Components intended for use in applications involving contact with corrosive or abrasive substances, where specifically designed parts for such environments are required, are covered)

  • Parts that may come into contact with chemicals

  • Overpressure Damage: This warranty does not cover damages resulting from overpressure conditions. Customers are required to adhere to the specifications outlined in the data sheet provided with the product. Failure to comply with these specifications will void the warranty.

Conditions:

This warranty is valid only if the following conditions are met:

  1. The product is installed and operated following the manufacturer’s instructions and recommendations.

  2. The product is used under normal operating conditions.

  3. The product has not been modified, altered, or repaired by unauthorized personnel.

Claim Procedure:

In the event of a defect covered by this warranty, the customer must:

  1. Notify the company (the warrantor) in writing within thirty (30) days of the discovery of the defect.

  2. Provide proof of purchase and installation date.

  3. Provide a detailed description of the defect.

  4. Return the defective product to the company (if requested) for inspection.

Remedies:

Upon validation of a warranty claim, the company will, at its sole discretion, either:

  1. Repair the defective product.

  2. Replace the defective product with a new or refurbished product of equivalent functionality.

Limitation of Liability:

The company’s liability under this warranty is limited to the repair or replacement of the defective product. The company shall not be liable for any indirect, incidental, or consequential damages, including but not limited to:

  • Loss of profits

  • Loss of production

  • Downtime

  • Damage to other equipment

Data Sheet & Technical Documentation:

The customer is responsible for reviewing and adhering to the specifications and guidelines provided in the Data Sheet & Technical Documentation accompanying the product. The data sheet & Technical Documentation contain critical information regarding the product’s proper use, operation, and limitations, particularly concerning pressure limits and allowed materials.

Governing Law:

This warranty shall be governed by and construed following the laws of Miami-Dade.

Entire Agreement:

This warranty constitutes the entire agreement between the parties concerning the product and supersedes all prior or contemporaneous agreements, representations, or understandings, whether oral or written.

GARANTÍA DEL PRODUCTO

Esta garantía cubre todos los productos comerciales, sistemas de ingeniería y software de 

Sunbelt Mechatronics LLC.

Periodo de garantía:

El período de garantía es de doce (12) meses a partir de la fecha de instalación.

Alcance de la garantía:

Esta garantía cubre defectos de materiales y mano de obra en condiciones normales de uso y servicio.

Exclusiones:

Esta garantía no cubre lo siguiente:

Piezas de desgaste: Las piezas sujetas a desgaste normal están excluidas de esta garantía. Estas pueden incluir, entre otras:

  • Piezas en contacto mecánico

  • Piezas móviles

  • Piezas bajo presión

  • Piezas que puedan entrar en contacto con sustancias corrosivas o abrasivas (los componentes diseñados para su uso en aplicaciones que impliquen contacto con sustancias corrosivas o abrasivas, donde se requieren piezas diseñadas específicamente para dichos entornos, están cubiertos).

  • Piezas que puedan entrar en contacto con productos químicos.

  • Daños por sobrepresión: Los daños resultantes de condiciones de sobrepresión no están cubiertos por esta garantía. Los clientes deben cumplir con las especificaciones descritas en la hoja de datos proporcionada con el producto. El incumplimiento de estas especificaciones anulará la garantía.

Condiciones:

Esta garantía sólo es válida si se cumplen las siguientes condiciones:

  • El producto se instala y opera siguiendo las instrucciones y recomendaciones del fabricante.

  • El producto se utiliza en condiciones normales de funcionamiento.

  • El producto no ha sido modificado, alterado ni reparado por personal no autorizado.

Procedimiento de reclamación:

En caso de un defecto cubierto por esta garantía, el cliente debe:

  1. Notificar a la empresa (el garante) por escrito dentro de los treinta (30) días siguientes al descubrimiento del defecto.

  2. Proporcionar comprobante de compra y la fecha de instalación.

  3. Proporcionar una descripción detallada del defecto.

  4. Devolver el producto defectuoso a la empresa (si se solicita) para su inspección.

Remedios:

Tras la validación de una reclamación de garantía, la empresa, a su entera discreción, podrá:

  • Reparar el producto defectuoso.

  • Reemplazar el producto defectuoso por uno nuevo o reacondicionado de funcionalidad equivalente.

Limitación de responsabilidad:

La responsabilidad de la empresa bajo esta garantía se limita a la reparación o el reemplazo del producto defectuoso. La empresa no será responsable de ningún daño indirecto, incidental o consecuente, incluyendo, entre otros:

  • Lluvia de ganancias

  • Pérdida de producción

  • Tiempo de inactividad

  • Daños a otros equipos

Hoja de datos y documentación técnica:

El cliente es responsable de revisar y cumplir las especificaciones y directrices proporcionadas en la hoja de datos y la documentación técnica que acompañan al producto. La hoja de datos y la documentación técnica contienen información esencial sobre el uso, el funcionamiento y las limitaciones del producto, en particular sobre los límites de presión y los materiales permitidos.

Ley aplicable:

Esta garantía se regirá e interpretará conforme a las leyes de Miami-Dade.

Acuerdo completo:

Esta garantía constituye el acuerdo completo entre las partes en relación con el producto y reemplaza todos los acuerdos, declaraciones o entendimientos anteriores o contemporáneos, ya sean orales o escritos.

General Terms and Conditions of Sale

  1. DEFINITIONS

Company: SunbeltMechatronics LLC, located at 1949 NE 164th St, North Miami Beach, FL 33162, Stati Uniti

Customer: The individual or entity purchasing Products from the Company.

Products: The assembled goods manufactured and sold by the Company.

Parts: The individual components assembled to create the Products.

Order: A purchase request submitted by the Customer for the Products.

Confirmation: The Company’s written acceptance of the Customer’s Order.

Price: The agreed-upon cost of the Products, excluding shipping and taxes.

Shipping Provider: The third-party company responsible for transporting the Products.

Shipping Costs: The fees charged by the Shipping Provider for delivery.

Delivery: The point at which the Products are transferred to the Shipping Provider.

Terms: These General Terms and Conditions of Sale.

 

  1. ORDER AND CONFIRMATION

Orders placed by the Customer are subject to acceptance by the Company.

A binding contract is formed only upon the Company’s written Confirmation of the Order.

The Confirmation will specify the Products, quantities, Price, and estimated delivery time frame (if applicable).

The Company reserves the right to refuse any Order at its sole discretion.

Any modifications to an Order after Confirmation require the written consent of both parties.

 

  1. PRICE AND PAYMENT

The Price of the Products is as specified in the Company’s quotation or price list at the time of the Order, unless otherwise agreed in writing.

Prices are exclusive of shipping costs, taxes (including VAT or sales tax), duties, and other charges, which will be added to the invoice where applicable.

Payment terms will be specified in the Confirmation or invoice. Accepted payment methods may include bank transfer, credit card. The Company may require a partial or full prepayment. 

Late payments may incur interest charges, not exceeding the maximum rate permitted by law.

  1. ASSEMBLY AND SPECIFICATIONS

The Products are assembled using Parts that meet the Company’s internal quality standards.

The Company strives to ensure that the assembled Products conform to the specifications provided in its product documentation or as otherwise agreed in writing.

Minor variations in the final assembled Product that do not materially affect form, fit, or function are acceptable.

Any specific assembly requirements beyond the Company’s standard procedures must be clearly communicated by the Customer and may be subject to additional charges and feasibility assessment.

  1. SHIPPING AND DELIVERY

The Company will arrange for shipment of the Products through a third-party Shipping Provider.

Delivery occurs when the Products are handed over to the Shipping Provider at the Company’s premises or designated shipping point.

The Customer is responsible for all Freight, Shipping, and Packaging Costs, which will be added to the invoice or billed separately.

Shipping timelines provided by the Company are estimates only and are not guaranteed. The Company is not liable for delays caused by the Shipping Provider or events beyond its reasonable control.

Risk of loss and damage to the Products passes to the Customer upon Delivery to the Shipping Provider.

The Customer is responsible for providing accurate shipping information. The Company is not liable for delays or additional costs arising from incorrect or incomplete shipping details.

The Customer is responsible for inspecting the shipment upon arrival and notifying the Shipping Provider and the Company of any damage or discrepancies immediately upon receipt, following the Shipping Provider’s procedures.

  1. INSPECTION AND ACCEPTANCE

Upon receipt, the Customer is responsible for inspecting the Products promptly.

Unless the Customer provides written notice of any defects or non-conformity within 8 (eight) days of receipt, the Products will be deemed accepted.

Any claims for defects or non-conformity must clearly specify the issue and be accompanied by supporting documentation (e.g., photos).

  1. WARRANTY AND LIABILITY

The Company warrants that its assembled Products will be free from material defects in workmanship and materials for a period of 12 (twelve) months from the date of DA DEFINIRE This warranty does not cover defects or damage caused by misuse, neglect, improper handling, unauthorized modifications, or normal wear and tear.

The Company’s sole obligation under this warranty is, at its option, to repair or replace the defective Product, provided that the Customer has notified the Company of the defect within the warranty period and returned the Product according to the Company’s instructions.

Disclaimer of Other Warranties: EXCEPT AS EXPRESSLY PROVIDED HEREIN, THE COMPANY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO,  WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

To the maximum extent permitted by law, the Company’s liability for any claims arising out of or related to the Products or these Terms is limited to the purchase price of the specific Products in question.

The Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of use, or business interruption, even if the Company has been advised of the possibility of such damages.

The Customer acknowledges that the Shipping is performed by a third-party provider, and the Company is not liable for any loss, damage, or delay caused by the Shipping Provider. Any claims related to shipping should be directed to the Shipping Provider according to their terms and conditions.

  1. RETURNS AND REFUNDS

Returns are accepted only for defective Products covered under the warranty and with the Company’s prior written authorization.

Returned Products must be in pristine condition and include all accessories.

The Customer is responsible for the cost of return shipping unless the return is due to a confirmed defect covered by the warranty.

Upon verification of a valid warranty claim, the Company will, at its option, repair or replace the defective Product or issue a partial or total refund.

Refunds will be processed within 30 (thirty) days of the Company’s confirmation of the valid return.

  1. FORCE MAJEURE

The Company shall not be liable for any delay or failure to perform its obligations under these Terms due to event  beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, fire, floods, strikes, lockouts, accidents, shortages of materials, delays in transportation by the Shipping Provider or other carriers, or governmental regulations.

  1. INTELLECTUAL PROPERTY

Any intellectual property rights related to the Products, including designs, specifications, and trademarks, remain the sole property of the Company. The Customer is granted a limited, non-exclusive license to use the Products for their intended purpose.

  1. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Florida. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Miami-Dade.

  1. ENTIRE AGREEMENT

These Terms constitute the entire agreement between the Company and the Customer with respect to the subject matter hereof and supersede all prior or contemporaneous communications and proposals, whether oral or written.

  1. SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

  1. MODIFICATIONS

The Company reserves the right to modify these Terms at any time. Updated Terms will be posted on the Company’s website or otherwise communicated to the Customer. Continued business with the Company after such modifications constitutes acceptance of the revised Terms.
